Welcome to Active English! These Terms of Service ("Terms") govern your use of the Active English mobile application ("App") operated by Volodymyr Popov ("we", "our", or "us").

By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 16 years old to use this App. By using the App, you represent that you are at least 16 years of age.

2. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

3. Subscription and Payments

Free Features: Basic features of the App are available for free with limitations.

Premium Subscription: Premium features require a paid subscription. By subscribing, you agree to:

• Pay the applicable subscription fees
• Automatic renewal unless cancelled before the renewal date
• Manage your subscription through the App Store (iOS) or Google Play (Android)

Refunds: Refund requests are handled by Apple App Store or Google Play according to their respective policies.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App to harass, abuse, or harm others
• Submit content that is offensive, defamatory, or illegal

5. User Content

You retain ownership of content you create (essays, vocabulary lists, etc.). By using the App, you grant us a license to process your content solely for providing the App's services, including AI-powered feedback.

6. AI-Generated Content

The App uses artificial intelligence to provide essay feedback and evaluations. AI-generated content is provided for educational purposes only and may not always be accurate. We do not guarantee the accuracy or completeness of AI feedback.

7. Intellectual Property

The App, including its design, features, content, and code, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that:

• The App will be error-free or uninterrupted
• Learning outcomes or language proficiency improvements
• The accuracy of AI-generated feedback

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the App settings.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by applicable laws. Any disputes shall be resolved through good-faith negotiation or applicable dispute resolution mechanisms.
